Terms of Service

The rules of the road for using WebFixit and buying a care plan. Month-to-month, no lock-in surprises.

Last updated: July 22, 2026. This is a general-purpose terms of service for WebFixit (webfixit.io). It is a reasonable working draft, not a substitute for review by a qualified attorney in your jurisdiction, particularly for high-value or enterprise engagements.

1. Acceptance of these terms

By using webfixit.io or purchasing a WebFixit care plan, you ("Client", "you") agree to these Terms of Service ("Terms"). If you are agreeing on behalf of a company, you represent that you have authority to bind that company.

2. Description of services

WebFixit provides WordPress maintenance and related services: updates, backups, uptime monitoring, security hardening, staging verification, and, on eligible plans, white-label reporting and development edit hours, as described on our pricing and service pages. Exact scope varies by plan tier and is confirmed at signup.

Emergency work outside plan scope, such as active hack cleanup beyond standard malware removal, urgent custom development, or site recovery from causes outside our standard backup/restore process, may be quoted and billed separately from your monthly plan.

3. Service levels are targets, not guarantees

Response times, uptime figures, and similar performance figures referenced in our marketing materials (for example on our pricing or comparison pages) are service targets, not contractual guarantees, unless a specific service level is expressly stated in a signed Statement of Work (SOW) or order form between you and WebFixit. Where a signed SOW states a binding SLA, that SOW controls over any conflicting marketing statement.

4. Payment, refunds & cancellation

  • Care plans are billed monthly in advance unless otherwise stated at signup.
  • Cancel anytime. All plans are month-to-month with no annual lock-in, unless you've signed a separate order form or SOW that expressly states a fixed term.
  • Cancellation takes effect at the end of the current billing period; fees already paid for the current period are generally non-refundable, except where required by law or expressly stated in your order confirmation (for example, an introductory satisfaction guarantee offered at signup).
  • We may change plan pricing with reasonable prior notice; continued use after a price change takes effect constitutes acceptance of the new price.
  • Late or failed payments may result in suspension of services until resolved.

5. Client responsibilities & credential confidentiality

  • You must have the authority to grant us access to any site you enroll, and to provide any credentials or access tokens we request to perform maintenance work.
  • You are responsible for maintaining accurate access details and notifying us promptly of any change (new hosting provider, changed passwords, revoked API keys).
  • We treat WordPress admin credentials, hosting access, and any other access you provide as confidential, use them solely to deliver the Services, and store them using access controls appropriate to their sensitivity. You agree to keep any credentials or portal access we provide to you similarly confidential.
  • You won't use the Services for illegal activity or to violate the rights of any third party.

6. Intellectual property ownership

You retain all ownership of your website, its content, and any data stored on it. We claim no ownership over your site or content. WebFixit retains ownership of its own tools, processes, documentation, and any pre-existing intellectual property used to deliver the Services. Custom development work is governed by the terms of your specific order form or SOW, which will state what, if anything, transfers to you.

7. Warranty disclaimer

Except as expressly stated in a signed SOW, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that every update will be free of unintended side effects, though we take reasonable steps, including staging verification on eligible plans, to reduce that risk.

8. Limitation of liability

To the maximum extent permitted by law, WebFixit and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from or related to your use of the Services, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Services will not exceed the total fees you paid to WebFixit in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnification

You agree to indemnify and hold WebFixit harmless from any third-party claims, damages, or expenses (including reasonable legal fees) arising from your content, your misuse of the Services, or your violation of these Terms or applicable law.

We agree to indemnify and hold you harmless from third-party claims arising from our gross negligence or willful misconduct in performing the Services, subject to the limitation of liability in Section 8.

10. Termination

Either party may terminate the relationship at any time in accordance with Section 4 (Payment, refunds & cancellation). We may also suspend or terminate access immediately if you fail to pay outstanding fees, use the Services in violation of these Terms, or in a way that creates risk to WebFixit or other clients. On termination, we will reasonably assist with exporting your site data and revoking our access, and any outstanding fees for services already rendered remain due.

11. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Update this to your actual registered jurisdiction before relying on these Terms. Any dispute not resolved informally will be brought exclusively in the courts located in that jurisdiction, and both parties consent to that venue.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
